Texas child Custody

In Texas, and other states as well, child custody decision made in a family court has been changed drastically in recent years. Early in 1900's, fathers were typically given the child custody in a divorce. However, fathers no longer get granted the child custody right today even if the mother is making less money.

The first shift toward giving the mother the custody right was based on the understanding that mother usually is the major caregiver of the child therefore can best take care of the child. This shift changed again in 1970's when the focus was put on the best interest of the child. It means that regardless whether you are the mother or the father, your child's best interest will be the major consideration in deciding the child custody rights.

There are two types of child custody rights:

1. Physical child custody - you live with your child and take care of your child's everyday needs, such as food, clothing, and school/after school activities

2. Psychological custody - you make decisions on the education your child is going to receive, the religion and other critical factors that will impact your child's development in long term.

As a mother, you need to prove to the court that you are the best caregiver for your child on a daily basis:

1. You have spent most of the time with your child and have a vey close relationship

2. You have decided to stay in the same house or neighborhood so that your child can go to the same school and keep all his or her friends

3. You have more available timeto share with your child

4. You have enough financial resource to provide a good life style for your child

5. You can work with your ex to make decisions and arrange important events, such as vacations, trips and birthday parties for your child. This is hard for you to do but don't forget that the child best interest counts, nothing else.
