When a marriage has been falling apart for quite some time, divorce is often the only option left for the couple. Getting a legal separation is a task that sometimes drags on for months and even years though. All things must be dealt with on the legal level, such as who will take custody of the children, how the marital assets will be divided, even the consideration of child support and alimony payments must be dealt with. For these very reasons, most people run out to hire legal representation before doing anything else.

When the instance occurs that bring in outside parties needs to be done you will find that you actually have many different options, most being highly affordable. In some cases, though, the marriage can actually be dissolved without the need for a lawyer for either party involved.

While this is a great options for many people, depending on your situation it may not be the most effective for you.

The first thing you should look at when tying to determine if you will be able to file Pro Se is whether or not it will be uncontested by the parties involved even if there are children or martial properties.

Uncontested means you won't be able to involve any kind of stocks, investments, retirement accounts or anything of the like. You will not deal with any type of alimony decision in a Pro Se divorce either, so if this is a concern you will need to still hire a lawyer to take of these things.

For the best possible outcome, it is ideal that both you and your spouse agree to do things Pro Se and no one hires any legal help. If you are dealing with a military divorce, on the other hand, you will definitely need a lawyer even if the separation is uncontested, simply because there are a few extra laws in place when it comes to a matter such as this.

To recap the things discussed above, Pro Se can be a much more affordable options for many people but you must fall within the realm of qualifying circumstances in order to use this option. The matter must be uncontested by both parties and not involved any thing like child custody or division of property that needs to be sorted out with a judge. You and your spouse should both be in agreement on doing things this way so that neither side retains a lawyer and if anything comes up that you would need a lawyer for than you will have to go ahead and file and get Divorce services the more traditional way.
