When a man and woman get married they are planning to be together for life. Real life sometimes rudely interrupts the best laid plans. Which is how a trip down the aisle ends in an overseas divorce.

Obviously this is only to be considered as a last resort. Walking away from heartfelt vows made before church and family is a serious undertaking. The essence of marriage is about more that just the bride and groom but also uniting two families.

The tricky factor is multiplied if children are involved. Everyone knows the need love and a supportive household with two parents. Which is not a legitimate excuse for two adults to make each other miserable in a misguided attempt to protect the kids.

If there is no other solution and divorce is the only option then so be it. However both parties are strongly advised to contest the suit back on home territory. There are several compelling reasons for this.

The most important reason is that of jurisdiction. It becomes tricky legal territory trying to enforce a countries laws in another sovereign nation. Even the most skilled attorney will encounter several problems with this.

Something that is a vital as obtaining money from a spouse for basics in the form of alimony and child support might have no legal equivalent overseas. As for custody battles we have seen enough true life movies to know this is not often a story with a happy ending. Hiring an attorney is no guarantee of success given the obstacles above.

The bottom line is that an overseas divorce is definitely not a desirable option for anyone involved. Aside from the off chance that the divorce will not be recognized once on home soil there are too many stumbling blocks. Best to wait it out then have the certainty that things will be finalized legal on home territory.
