For Wills And Estate Planning New York Needs To Think About The Family

By Erna Walls

In the event of an unexpected loss in the family due to death, the burden of having to deal with an asset where no proper or valid will was left behind can cause major trauma to the family. Families have enough to deal with when in the midst of grief and having to deal with a deceased persons estate who made no proper plans in the event of his or her death will certainly not be a comfort. We list below the following four points that should be present for a will to be legitimate. These represent what is necessary for a valid will for wills and estate planning New York.

To have a valid will demands that the person be old enough and psychologically healthy. The person concerned needs to have reached an age of at least eighteen years. They also need to be of a clear and sober mind to ensure that what is decided in the will is not done with impaired or compromised judgement.

It is a requirement that the will bear the signature of the person whose will it is. The signature should be at the end of the will. This signature notes the acknowledgement by the testator (a legal term describing the person whose will it is) that he or she accepts and is aware of the legal implications involved in creating the will. A will that has no signature is the equivalent of not having any will at all.

It is also wothwhile to note that there needs to be two or more witnesses when a will is being signed. These witnesses need to confirm that they were present when the will was being signed by the person who owns the will. The confirmation of this acceptance by the witnesses needs to be legally noted by them also signing the document.

A necessary requirement also states that the testator needs to point out to the witnesses that he or she has signed and is committed to what has been mentioned. There is now no doubt that what has been witnessed to and what has been acknowledged is a valid will.

For valid wills and estate planning New York residents need to be prepared and ready for the unexpected. This is a matter of life or death and a person needs to ensure their your responsibilities have been taken are of before time runs out. wills and estate planning new york
