The Need For Separation Agreement

There are a lot of things that can go wrong in a marriage. When this happens, there may be reconciliation, separation or divorce. Whichever route it goes depends on the arrangement of the couples. If you have decided to part ways then you will have to check your separation agreement for the way forward.

There are some instances when a legal divorce may be too nasty. This is usually the case when one person feels strongly that he or she has been wronged. It may also happen when there are a lot of assets to be divided. These are the kinds of divorces that take long and involve nasty revelations about the secrets of the involved parties.

There are different laws governing these cases in different states. If you want to divorce you might have to live separately for some time first. It all depends on the state hosting the proceedings. Sometimes this living apart is not necessary at all. A legal agreement is usually drawn detailing how their belongings will be shared in the event that they actually divorce.

Every little detail has to be covered in this document, from kids to liabilities. Usually, a lot of negotiations and compromises take place before they finally settle all their points. It is at this point that two witnesses are required to witness the signing of the document.

A divorce is costly. You need a lot of money to pay the lawyers. This is only true, however, if it is a contested divorce. If it is not contested then you will spend considerably little money. It is a wise couple indeed that opts for this process. In addition to money they will avoid a lot of misery this way.

There is a peculiar thing that has been noted with many couples intending to divorce. Spending some time apart sometimes reconciles them. Perhaps they get time to think about their contributions to the break up. A lot of accusations are usually made when couples file for divorce. Everybody tends to think of themselves as the aggrieved party.

If you have never been involved in a divorce it is hard to understand how much people change. The accusations and counter accusations that take place are sometimes unbelievable. Contrasting these scenes with the wedding ones is awful. It is one of the places where you get to understand the reality of human nature.

The good thing with this agreement is that it is a voluntary procedure. You cannot force a partner into signing one. Neither can you be forced into one. If you succeed into coercing somebody into one, it will never hold once you are found out. It is a good thing though, if both of you agree to it. You will save yourselves from a lot of public embarrassment.

A separation agreement does not necessarily mean that the couple lives apart. It is just a legal document specifying their divorce arrangements when it eventfully goes through. Divorce can be a nasty process but sometimes it just has to happen. There are some irreconcilable differences that may come into a marriage. Sometimes, divorce is the only cure.
